Absence of damage as independent basis for denying revision despite alleged fundamental legal significance
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof rejected the plaintiff's non-allowance complaint, leaving the appellate court's judgment in force and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a civil law claim where the plaintiff sought to challenge the lower court's refusal to allow an appeal to the supreme court, arguing issues of fundamental legal significance and alleged violations of procedural fundamental rights. The court held that the legal questions were not decisively important because the appellate decision was independently based on the finding that no damage occurred, and the procedural objections were not sustained. The decision was based on § 543(2) and § 544(6) of the Code of Civil Procedure (ZPO), specifically denying the existence of fundamental legal significance or the need for legal unification, and abridging the reasoning as it would not contribute to clarifying the prerequisites for allowing revision.
