Product liability: Absence of unauthorized shutdown device and admissibility of revision for fundamental legal significance
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, rejecting the appeal and leaving the Munich Regional Court of Appeal's decision in force; the plaintiff bore the procedural costs. The dispute concerned product liability claims under § 823 Abs. 2 BGB in conjunction with the EU General Food Law Regulation, where the appellate court independently grounded its denial of liability on the absence of an impermissible shutdown device in the contested machinery. The BGH held that the lower court's reasoning was legally sound from its perspective and that the plaintiff failed to demonstrate a question of fundamental legal significance or the need for the development of law or the unification of jurisprudence, thereby failing to meet the statutory admissibility criteria for revision under § 543 Abs. 2 ZPO.
