Tort liability of motor manufacturer for intentional participation in vehicle manufacturer's regulatory violation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the denial of leave to appeal, upholding the lower court's judgment in favor of the defendant. The dispute concerned a tort claim by a vehicle owner against a motor manufacturer, allegedly for participation in an intentional violation of the European Food Law Regulation (EG-FGV) by a vehicle manufacturer, as well as general tort liability. The court found no grounds for revision because the plaintiff failed to demonstrate that the motor manufacturer, as distinct from the vehicle manufacturer, had intentionally participated in a statutory violation under § 823(2) BGB i.n.c. with §§ 6(1), 27(1) EG-FGV, nor did the claim under §§ 826, 31 BGB establish a justifying reason for admission. Consequently, the plaintiff bears the costs of the proceedings, and the prior judgment denying liability remains in force.
