Exemption of interest on out-of-court attorney fees: leave to appeal on cost allocation
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) granted the plaintiff's leave to appeal (Revision) regarding the plaintiff's claim for exemption from interest on out-of-court attorney fees, thereby reversing the partial denial of that specific claim by the Oberlandesgericht Nürnberg, while denying leave to appeal on all other grounds. The case involved a civil dispute where the plaintiff challenged the lower court's ruling on costs, specifically arguing that interest on out-of-court attorney fees should not be recoverable or should be treated differently under procedural law. The decisive legal basis rests on the interpretive precedents established in BGH decisions XI ZR 508/15, IX ZR 267/17, and VIa ZR 1139/22 concerning the treatment of interest on legal fees, with the court dispensing with written reasoning pursuant to § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO.
