The Federal Court of Justice (4th Civil Senate) dismissed the defendant's complaint against the non-admission of revision, thereby leaving the judgment of the Munich Higher Regional Court of April 18, 2023, in force and upholding the plaintiff's prevailing position. The dispute concerned an insurance-related civil matter, with a disputed value assessed at up to EUR 45,000, where the defendant challenged the admission of a further appeal to the supreme court. The Court determined that the case lacked fundamental legal significance and did not require the development of law or the securing of uniform jurisprudence under Section 543(2) Sentence 1 of the Code of Civil Procedure, and explicitly rejected the defendant's complaints regarding the violation of the right to be heard under Article 103(1) of the Basic Law, ordering the defendant to bear the costs of the complaint proceedings.
