Die Entscheidung über die Einziehung des Wertes von Taterträgen erweist sich in mehrfacher Hinsicht als rechtsfehlerhaft. So hat das Landgericht bei der Berechnung der Taterträge des Angeklagten einerseits auch „Verkaufspreise“ in Ansatz gebracht, die er noch nicht erzielt hatte, etwa 360 Euro für zwölf Gramm Metamphetamin, die sein Abnehmer F. weiterveräußert, aber noch nicht bezahlt hatte. Auch hat es dabei Betäubungsmittel berücksichtigt, die der Angeklagte seinen Abnehmern den Feststellungen zufolge in dem abgeurteilten Fall nicht veräußerte (Levometamphetamin). Andererseits hat die Strafkammer in darüber hinausgehendem Maße Beträge abgezogen, die seine Abnehmer dem Angeklagten noch „schuldeten“, und nicht alle Erlöse in die Rechnung eingestellt, die er tatsächlich hatte. Im Ergebnis wirken sich die Rechtsfehler deshalb nicht zu seinem Nachteil aus.
