Admissibility of non-acceptance complaint for lack of fundamental legal significance in civil litigation
Legislator-Zusammenfassung
KI-generiertThe defendant's complaint for non-acceptance of revision was dismissed, leaving the judgment of the 7th Civil Chamber of the Regional Court Kiel dated March 8, 2023, in force. The dispute concerned a civil claim where the defendant, also the counterclaimant, challenged the lower court's refusal to accept a revision appeal, while the underlying counterclaim involved an amount in dispute of €28,560, calculated based on a base value of €850 over 3.5 years with a 20% deduction for declaratory relief. The Federal Court of Justice held that the case raised no questions of fundamental legal significance and that a decision was neither necessary for the development of law nor for the assurance of uniform jurisprudence, thereby rejecting the appeal under § 543 Abs. 2 ZPO and ordering the defendant to bear the costs of the proceedings.

Senat, Beschluss vom 12. März 2020 - V ZR 160/19, NJW-RR 2020, 640 Rn. 5).
