Whether prior consideration of multiple-victim aggravation and significant temporal gaps between offenses barred further use of those factors in total sentence calculation under § 337 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (4th Criminal Senate) rejected the defendant's appeal as unfounded, leaving the Landgericht Münster’s conviction and sentence from May 31, 2023, in force and ordering the defendant to bear the costs of the appeal and the victim associates' necessary expenses. The dispute centered on whether the trial court committed a legal error by citing the aggravating factor that the defendant committed acts against multiple victims in the individualized sentencing phase, given that this factor had already been considered when determining the individual sentences and that a significant temporal gap (over a decade) separated the first series of offenses from the later ones. The court held that the potential legal defects in the sentencing reasoning did not warrant a reversal because it could exclude that the trial court would have imposed milder individual sentences or a lower total sentence without that specific aggravating consideration, pursuant to § 337 Abs. 1 StPO.
