Applicability of aggravated juvenile sentencing framework to aiding and abetting offenses and harmless error review of statutory maximum misapplication
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Revisions (BGH) dismissed the defendant's appeal as unfounded, upholding the lower court's conviction and sentence. The case involved a juvenile defendant convicted of aiding and abetting dangerous bodily harm in concurrence with the violation of the highest personal living sphere by image recordings; the defendant challenged the judgment on procedural grounds. Although the appellate court noted a legal error where the first instance incorrectly applied the aggravated sentencing framework for crimes (Vergehen vs. Verbrechen distinction under the Juvenile Court Act), it held the result was correct because the juvenile prison sentence was primarily based on educational needs rather than the statutory maximum, rendering the error harmless. Consequently, the juvenile defendant is ordered to bear the necessary costs incurred by the counterparty during the revision proceedings.

Oktober 2018 – 4 StR 314/18 Rn. 5; Urteil vom 20. Dezember 2012 – 3 StR 117/12 Rn. 52).
