Admissibility of revision complaint regarding tort liability for motor manufacturer's participation in vehicle manufacturer's violation of European Food and Feed Law
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof (BGH) dismissed the plaintiff's non-admission complaint, upholding the lower court's refusal to allow an appeal for revision. The dispute involved a civil tort claim where the plaintiff alleged liability based on § 823 (2) German Civil Code in conjunction with § 6 (1) and § 27 (1) of the European Food and Feed Law (EG-FGV), asserting that the defendant, a motor manufacturer, had participated in the intentional statutory violation of a vehicle manufacturer. The BGH held that the complaint failed because the plaintiff did not sufficiently demonstrate the decisional relevance of the admissibility grounds, specifically failing to substantiate the alleged intentional legal violation by the vehicle manufacturer that the motor manufacturer could have joined. Consequently, the decision of the 16a Civil Senate of the Stuttgart Higher Regional Court remains in force, and the plaintiff is ordered to bear the costs of the complaint proceedings.
