Tort claim under § 823 para. 2 BGB for violation of food law provisions: non-admission of appeal due to failure to challenge appellate finding of absence of damage
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's non-admission complaint, leaving the appellate court's decision in force. The dispute involved a tort claim under § 823 para. 2 BGB in conjunction with § 6 para. 1 and § 27 para. 1 of the General Food Law (EG-FGV). The court held that the legal questions raised lacked fundamental significance and did not require legal development or the assurance of uniform case law because the plaintiff failed to effectively challenge the appellate court's factual finding that no damage had been sustained. Consequently, the complaint was rejected under § 543 para. 2 sentence 1 ZPO, the plaintiff was ordered to bear the costs of the proceedings, and the dispute value was set at up to 30,000 €.
