The German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's non-allowance complaint, thereby upholding the appellate court's decision that refused leave to appeal; the plaintiff bears the costs of the proceedings, which are assessed at a value up to €25,000. The dispute concerned a civil case where the plaintiff challenged the appellate court’s refusal to allow a revision on the grounds of alleged fundamental procedural rights violations and the need for legal clarification, specifically arguing that the European Court of Justice judgment of March 21, 2023 (C-100/21) was decisive. The BGH found no ground for admission under Section 543(2) of the Code of Civil Procedure (ZPO) because the appellate court’s judgment was independently founded on issues of damage establishment and limitation periods, which were not materially affected by the ECJ ruling, and the alleged procedural rights violations were deemed insufficient to warrant review.

Volltext
