Fault-based liability as independent ground for rejecting non-admission of civil appeal despite claimed fundamental legal significance
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint for non-admission of appeal, upholding the decision of the Cologne Higher Regional Court of 27 December 2022 and ordering the plaintiff to bear the costs of the complaint proceedings. The dispute concerned a civil matter where the plaintiff attempted to challenge the lower court's judgment by arguing that the legal questions raised were of fundamental significance or necessary for the development of law. The appellate court’s ruling was self-supportingly based on considerations of fault (*Verschulden*), which the plaintiff failed to demonstrate were subject to a decisive legal error warranting review. The highest court applied §§ 543, 544, and 97 ZPO, finding that the plaintiff had not sufficiently substantiated the decisional relevance of the legal issues under the requirements of fundamental significance (§ 543 Abs. 2 Satz 1 Nr. 1 ZPO) and that alleged procedural fundamental rights violations were not sufficiently demonstrated.
