The German Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of revision, thereby upholding the appellate court's decision in which the plaintiff's claim for damages was denied. The dispute centered on a tort claim under § 823(2) BGB in conjunction with the EU General Food Law Regulation, specifically concerning an alleged intentional violation of statutory duties by a vehicle manufacturer, with the plaintiff alleging that the defendant, acting as an engine manufacturer, participated in said violation. The court held that the legal issue lacked fundamental significance and that the plaintiff failed to demonstrate the decisional relevance of the grounds for admission, as the facts did not establish that the engine manufacturer participated in an intentional breach of law attributable to the vehicle manufacturer, citing prior BGH jurisprudence. Consequently, the plaintiff bears the costs of the complaint proceedings, and the appellate judgment remains final.
