Non-Admission of Revision: Unlawful Disconnection Devices and Fundamental Legal Significance in Consumer Transactions
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of an appeal in revision, thereby finalizing the appellate court's judgment in the plaintiff's favor for the opposing party and ordering the plaintiff to bear the costs of the proceedings. The case concerned a civil dispute where the plaintiff alleged defects in a consumer transaction, specifically challenging the presence of unlawful disconnection devices, but failed to demonstrate that the issue possessed fundamental legal significance or required the development of law for the uniform application of legal principles. The court held that the appellate court's decision was independently grounded on the absence of such devices and that the alleged procedural fundamental rights violations were not substantial, thereby finding no basis for admission under § 543 Abs. 2 ZPO.
