Admission of revision on tort liability for defectively designed vehicles
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) partially granted the plaintiff’s application for leave to appeal (Nichtzulassungsbeschwerde), allowing a revision to proceed solely regarding the dismissal of his tort claims arising from the defective design of a vehicle, while rejecting the complaint and upholding the lower court’s judgments on the contractual claims and second appellate request; consequently, the plaintiff succeeded in initiating further proceedings on the tortious liability issue but failed on all other aspects, bearing the associated costs for the unsuccessful portions. The case involved a product liability dispute where the plaintiff challenged an appellate court decision that had dismissed both his tort claims under German law for damages caused by placing a defective vehicle into circulation and his contractual claims. The decisive legal basis for the partial admission is § 543 Abs. 2 Satz 1 ZPO, as the BGH found that the tort claim issue possessed fundamental significance requiring the clarification of basic legal questions, whereas the contractual claims lacked such significance or the need for uniform jurisprudence, and alleged procedural rights violations were found insufficient.

BGH, Beschluss vom 17. Dezember 2003 - V ZR 343/02, NJW 2004, 1048 f.).
