Inadmissibility of appeal for failure to challenge alternative statute of limitations basis; denial of non-admission of appeal for lack of legal significance.
Legislator-Zusammenfassung
KI-generiertThe BGH dismissed the plaintiff's non-appeal complaint, leaving the lower court's dismissal of the claim intact and imposing the procedural costs on the plaintiff. The dispute concerned a civil action where the plaintiff's appeal was rejected on the grounds of procedural admissibility. The decisive legal basis was that the appeal was inadmissible because the plaintiff failed to challenge the lower court's independent legal basis of statute of limitations (Verjährung) in its appeal brief, rendering the appeal void under § 543 Abs. 2 Satz 1 ZPO and general principles of appellate review requiring a specific attack on all independent grounds for judgment.
