Non-admission complaint: Requirement of fundamental significance and legal uniformity for civil revision proceedings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 11th Civil Senate denied the plaintiff's application for a stay of proceedings and dismissed the plaintiff's non-admission complaint against the decision of the Munich Regional Court of Appeal, resulting in the plaintiff bearing the costs of the complaint proceedings. The dispute centered on a non-admission complaint where the appellant sought to challenge the lower court's refusal to admit revision, which the BGH rejected on the grounds that the matter lacked fundamental significance and did not require the unification of case law for the development of law. The decisive legal basis relied upon was Section 543 Paragraph 2 Sentence 1 of the Code of Civil Procedure (ZPO), with the court referencing prior consistent jurisprudence and applying Section 544 Paragraph 6 Sentence 2 Half-Sentence 2 ZPO to waive a further written justification.
