Admission of Revision on Liability for Defeat Devices: Effect of Type Approval on § 823(2) BGB Claims
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's judgment and leaving the plaintiff to bear the costs of the complaint proceedings. The dispute concerned a product liability claim for damages arising from the installation of unapproved "defeat devices" (engine software shutting off emissions controls) in a vehicle, where the appellate court had rejected the claims on the grounds that the statutory effect of the administrative type-approval act precluded liability. The decisive legal issue was whether the type-approval's legal validity bars tortious liability under § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1 and § 27 Abs. 1 of the EU Gasoline Directive (EG-FGV). The court found that the non-admission of revision was appropriate because no divergence from existing case law existed at the time the complaint was filed, noting that the Federal Court of Justice had only subsequently, in June 2023, established that such type-approval does not preclude claims for differential damage, and thus the prerequisite of divergent case law required for admission under § 543 Abs. 2 ZPO was not met.
