Denial of leave for lack of fundamental legal significance regarding Art. 3 No. 10 Regulation (EC) 715/2007
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's non-admission complaint, leaving the Oberlandesgericht Bamberg’s decision of July 26, 2022, in force, and ordered the plaintiff to bear the costs of the proceedings, with a value in dispute of up to €40,000. The dispute concerned an appeal for leave to appeal under the German Code of Civil Procedure, where the plaintiff challenged the lower court’s judgment by alleging a lack of fundamental legal significance and procedural fundamental rights violations. The court held that the complaint failed because the plaintiff did not sufficiently demonstrate the decision-relevance of the raised legal questions, specifically in light of the prerequisites of Article 3 No. 10 of Regulation (EC) No. 715/2007, and deemed the alleged procedural rights violations unsubstantiated. Relying on § 543 Abs. 2 Satz 1 ZPO and § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO, the court concluded that neither the development of law nor the assurance of uniform jurisprudence required a revision decision, and waived further reasoning.
