Regulation (EC) No. 715/2007 Art. 3(10); fundamental significance of gas market access regulation in non-admission proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (6th Civil Senate) rejected the plaintiff's complaint for non-admission of appeal, leaving the lower court's decision in force and ordering the plaintiff to bear the procedural costs. The dispute concerned the interpretation of Article 3 No. 10 of Regulation (EC) No. 715/2007, where the appellant argued that the legal questions raised possessed fundamental significance to justify a revision of the appellate judgment. The court held that the decisive issue of decision-relevance for fundamental legal significance was not sufficiently substantiated in light of the specific prerequisites of the cited EU regulation.
