Admissibility requirements for a hearing-rügen complaint under German civil procedure law
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint for lack of hearing (*Anhörungsrüge*) as inadmissible, leaving the appellate court’s judgment of September 14, 2018, in force. The dispute concerned a procedural challenge to a prior decision by the same Senate, where the plaintiff alleged a violation of the constitutional right to be heard by arguing that the court had rejected her procedural revisions without sufficient reasoning. Relying on § 321a Code of Civil Procedure, the court held that the complaint failed to meet statutory disclosure requirements, as merely repeating the arguments from the initial revision filing does not demonstrate a new and independent violation of Article 103(1) of the Basic Law; the plaintiff failed to provide specific circumstances proving that her submissions were not considered by the court, thereby warranting the dismissal of her challenge.

Begründungserfordernis einer Anhörungsrüge
[TENOR]
