The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby affirming the appellate court's judgment in favor of the defendant. The dispute concerned a claim for damages under § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1 and § 27 Abs. 1 EG-FGV, arising from alleged misconduct by a motor manufacturer regarding vehicle emissions standards. The court found that the complaint failed to demonstrate the decision-relevant relevance of the legal issues because the defendant was identified solely as a motor manufacturer rather than a vehicle manufacturer; consequently, the plaintiff did not sufficiently substantiate that an intentional legal violation by the vehicle manufacturer existed to which the motor manufacturer could have contributed as a participant. The plaintiff bears the costs of the proceedings.

Volltext
