Legislator-Zusammenfassung

The Federal Court of Justice (BGH) dismissed the defendant's appeal against a conviction by the Landgericht Hagen, rejecting the prosecution's application to uphold the original charges. The appeal was dismissed with the specific modification that the defendant was found guilty of procuring a minor to promote drug trafficking, supplying drugs to minors in two cases, trafficking in substantial quantities of narcotics in three cases (in concurrence with acquisition), possessing substantial quantities in three cases (in concurrence with trafficking), trafficking in seventeen cases, and trafficking in six cases (in concurrence with acquisition). The dispute concerned the legal sufficiency of the lower court's convictions for multiple offenses under German narcotics law, including the specific statutory aggravations for involving minors and dealing in "not trivial" or substantial amounts. The decisive legal basis rested on the revision court's authority to correct the verdict to match the legally sustainable findings of fact, specifically aligning the operative part of the judgment with the established guilty acts under the Narcotics Act while rejecting any claims for a full reversal.
