Admissibility of revision appeal for fundamental legal significance in civil proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the plaintiff's motion to suspend proceedings and dismissed his complaint for non-admission of appeal, thereby affirming the lower court's decision. The dispute concerned a civil matter before the 19th Civil Senate of the Higher Regional Court of Munich, where the plaintiff challenged the appellate court's refusal to allow a revision appeal. The court determined that the legal issues lacked fundamental significance and did not require a decision by the appellate court to ensure the uniform application of law or further the development of law, citing established precedents in its ruling. Consequently, the plaintiff was ordered to bear the costs of the complaint proceedings, with the amount in dispute set at up to 30,000 EUR.
