Tort claim against engine manufacturer for diesel emissions scandal: liability under § 823 Abs. 2 BGB with §§ 6, 27 EG-FGV and the necessity of substantiating intentional statutory violation by the vehicle manufacturer.
Legislator-Zusammenfassung
KI-generiertThe plaintiff's constitutional complaint for leave to appeal was dismissed, leaving the appellate court's judgment rejecting the claim in force. The dispute concerned a tort claim under German law, where the plaintiff sued an engine manufacturer alleging intentional statutory violations by a separate vehicle manufacturer, which the lower court had denied. The Federal Court of Civil Jurisdiction found that the complaint failed to demonstrate the decision's significance because the defendant is not a vehicle manufacturer and the plaintiff had insufficiently substantiated an intentional statutory violation by the vehicle manufacturer that the engine manufacturer could have joined. The dismissal was based on § 543 Abs. 2 Satz 1 ZPO and § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO, with the underlying substantive claim grounded in § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1 and § 27 Abs. 1 of the European Community Regulation on Fuel Quality (EG-FGV).
