Rejection of non-admission complaint in civil dispute for lack of fundamental legal significance under § 543(2) ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's application for a stay of proceedings and rejected his Non-Admission Complaint (Nichtzulassungsbeschwerde), thereby upholding the final decision of the Munich Higher Regional Court. The dispute concerned a civil law matter where the plaintiff sought to challenge the lower court's refusal to admit revision, arguing that the case possessed fundamental significance for the development of law. The BGH determined that the legal question lacked fundamental importance and did not require a decision by the revision court to ensure uniform jurisprudence, citing its prior rulings from 2020 as sufficient guidance. Consequently, the BGH applied § 543 Abs. 2 Satz 1 ZPO (requirements for admitting revision) and § 544 Abs. 6 Satz 2 ZPO (omission of detailed reasoning), and ordered the plaintiff to bear the costs of the appeal proceedings under § 97 Abs. 1 ZPO, setting the amount in dispute at €30,000.
