Joint and several liability designation in confiscation order for co-perpetrated offenses
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the defendant's appeal as unfounded but amended the judgment to correct the confiscation order, reducing the value-replacement amount from EUR 133,142.83 to EUR 120,827 and explicitly designating the defendant's liability as joint and several (Gesamtschuldner); the defendant bore the costs of the appeal. The dispute centered on a calculation error in the confiscation of value replacement for proceeds obtained through crime committed with an unknown accomplice, where the original lower court judgment had failed to specify the joint and several nature of the liability despite the established factual findings of co-perpetration. The decisive legal basis involved the correction of mathematical errors in confiscation amounts to match the actual asset flow to the defendant and the mandatory procedural requirement to designate joint and several liability in the operative part of the judgment when offenses are committed with an accomplice, eliminating the need to identify the unknown co-offenders.

Kennzeichnung einer gesamtschuldnerischen Haftung im Urteilstenor
[TENOR]
