Non-admission of revision for failure to demonstrate decision-relevance under EU Regulation No. 715/2007
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of revision, upholding the decision of the Stuttgart Regional Court of Appeals; the plaintiff bore the costs of the appellate proceedings, and the disputed value was capped at 40,000 €. The case involved a review of a lower court's refusal to admit an appeal on revision regarding a dispute subject to the scope of EU Regulation No. 715/2007. The BGH held that the plaintiff failed to demonstrate the decision-relevance of the legal questions raised under the doctrine of fundamental significance (Grundsatzbedeutung) as required by § 543(2) No. 1 ZPO in light of Article 3(10) of the cited Regulation. Consequently, pursuant to § 544(6) Sentence 2 ZPO, the court waived a detailed rationale, finding that one would not contribute to clarifying the prerequisites for admitting a revision, and dismissed the complaint for lack of general legal significance or need for legal development.
