Accessory liability under § 823 Abs. 2 BGB in conjunction with EU Food Law: failure to demonstrate participation in vehicle manufacturer's intentional regulatory breach
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of revision, upholding the appellate court's dismissal of the plaintiff's claim and leaving the lower court's judgment in force. The dispute concerned an alleged liability claim under § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1 and § 27 Abs. 1 of the EU General Food Law (EG-FGV), where the plaintiff, a consumer, sought to hold a defendant motor manufacturer liable for damages. The BGH found that the plaintiff failed to demonstrate that the legal question was of fundamental importance or necessary for the development of law, specifically failing to establish that the motor manufacturer could have been a participant in an intentional violation of law by the vehicle manufacturer, a distinction deemed decisive for applying the cited precedent on accessory liability.
