Liability of motor manufacturer for deliberate violation of food law by vehicle manufacturer under § 823(2) BGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of appeal, leaving the lower court's judgment in favor of the defendant in force. The dispute concerned a claim for damages under Section 823(2) of the Civil Code in conjunction with the German Food and Feed Law, where the plaintiff attempted to hold a motor manufacturer liable for a deliberate violation of law by the vehicle manufacturer. The court found no grounds for admitting the revision, as the plaintiff failed to sufficiently demonstrate that the motor manufacturer could have participated in the alleged intentional statutory breach, noting that the defendant was a motor rather than vehicle manufacturer; this reasoning was consistent with a concurrent decision by the court. The plaintiff was ordered to bear the costs of the complaint proceedings.
