The Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's decision and leaving the defendant's victory intact. The dispute concerned a claim for damages under § 823 Abs. 2 BGB in conjunction with the German Food and Feed Act (EG-FGV), where the plaintiff alleged a tortious violation of law in the context of vehicle emissions. The court rejected the appeal because the plaintiff failed to demonstrate the legal relevance of the grounds for admission; specifically, the defendant was identified as a motor manufacturer rather than a vehicle manufacturer, and the plaintiff did not sufficiently substantiate that the defendant participated in the alleged intentional statutory violation by the vehicle manufacturer. Consequently, the case was found to lack fundamental significance or a need for uniform legal development under § 543 Abs. 2 ZPO, and the plaintiff was ordered to bear the costs of the proceedings.
