The Federal Court of Justice (BGH) dismissed the defendant's application for legal aid to file a non-acceptance complaint, upholding the lower court's judgment and denying the defendant's intended challenge. The dispute concerned a civil procedure where the defendant sought to contest the appellate court's refusal to admit a revision appeal, but the application for legal aid was submitted on the final day of the statutory deadline without the mandatory declaration of personal and financial circumstances or supporting documents. These required documents were received by the BGH only after the deadline had expired. Relying on § 114 Abs. 1 Satz 1 ZPO, the court ruled that the intended legal action lacked a reasonable prospect of success because the strict statutory deadline for the non-acceptance complaint (§ 544 Abs. 1 Satz 2 ZPO) had lapsed, and readmission to the previous status for missed deadlines (§§ 233 ff. ZPO) was unavailable as the incomplete filing failed to constitute a timely and complete application.

Prozesskostenhilfe bei Nichtvorlage einer ordnungsgemäßen Erklärung

[TENOR]
