Admission of revision for uniform jurisprudence on EU directive conformity and good faith in insurance law
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower appellate court's judgment and awarding the plaintiff the costs of the proceedings; the disputed value was determined to be €253,074.17. This civil insurance law dispute arose from a challenge to a prior order that declined to allow appeal to the supreme court, with the plaintiff raising ineffective arguments based on fundamental rights (equality and fair trial) and questioning the EU directive conformity and good faith principles involved in the case. The court held that the case lacked fundamental legal significance, did not require the development of the law or uniform jurisprudence, and that the raised legal issues were not decisive or novel enough to warrant a reference to the European Court of Justice, applying §§ 543 and 544 of the Code of Civil Procedure to justify the refusal of a detailed reasoning.
