Official duty violation claims: exclusion of natural restitution in favor of monetary compensation under § 839 BGB
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Proceedings (BGH) dismissed the defendant's non-acceptance complaint against a final appeal inadmissibility decision, thereby upholding the Oberlandesgericht Naumburg’s judgment and denying leave for revision, with the defendant bearing the costs of the proceedings. The dispute involved a tort claim for damages arising from official duty violation, specifically concerning the restoration of a damaged power cable and the connection of garden plots, where the lower court had ordered specific performance (natural restitution). The BGH clarified that claims for damages under § 839 BGB in conjunction with Art. 34(1) GG generally permit only monetary compensation rather than an order for natural restitution, although the court noted that potential exceptions to this rule were not part of the admissibility review for this specific decision.
