Legislator-Zusammenfassung

The Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the Munich Higher Regional Court's decision and leaving the appeal inadmissible. The dispute concerned a civil insurance matter in which the plaintiff challenged the compatibility of an insurance policy model with EU directives and raised an objection based on the principle of good faith, attempting to secure a reference to the Court of Justice of the European Union. The court held that the EU directive compliance was not decisive for the outcome and that the good faith objection did not necessitate a preliminary reference, citing established jurisprudence, and ordered the plaintiff to bear the costs of the complaint proceedings.
