Legislator-Zusammenfassung

The Federal Court of Criminal Justice (BGH) dismissed the applicant's request for legal aid and the appointment of a specific attorney for the auxiliary prosecution, rejecting the application. The dispute concerned the procedural status of the auxiliary plaintiff in a criminal proceeding, where the applicant sought court-funded representation despite already having a court-appointed counsel. The decisive legal basis was the exclusionary effect of a prior appointment under § 397a Abs. 1 StPO, which remains valid for the entire procedure, combined with the principle that legal aid under § 397a Abs. 2 Satz 1 StPO is only available when the prerequisites for mandatory court appointment are not met.

Senat, Beschluss vom 1. Februar 2006 – 2 StR 602/05).
