Denial of damages under § 823 Abs. 2 BGB in EG-FGV disputes due to failure to establish engine manufacturer's participation in vehicle manufacturer's intentional statutory violation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of appeal in revision, leaving the appellate court's judgment in force and holding the plaintiff responsible for the costs of the complaint proceedings. The dispute concerned a claim for damages based on alleged violations of the Emissions Gasoline Vehicles Regulation (EG-FGV) in connection with § 823 para. 2 of the German Civil Code, where the defendant, acting as an engine manufacturer, was accused of contributing to intentional statutory violations by the vehicle manufacturer. The court held that the complaint failed to demonstrate the decisive relevance of the legal issues because the plaintiff had not sufficiently established that the defendant could have participated in the intentional breach of law by the vehicle manufacturer, thereby not meeting the requirements for admission of revision under § 543 para. 2 sentence 1 of the Code of Civil Procedure.
