The German Federal Court of Civil Procedure (BGH) dismissed the defendant's complaint against the non-acceptance of a revision appeal, upholding the lower court's judgment and fixing the subject-matter value (Gegenstandswert) of the appellate proceedings at 211,700 EUR based on the value of the property in question. The dispute concerned a real property case where the defendant, holding a prior registration claim (Auflassungsvormerkung), had encumbered a property with a mortgage before its transfer, prompting the plaintiff to sue for the delivery of the property, deletion of the registration claim, and removal of the mortgage, while the defendant counterclaimed for conveyance. The Court held that the plaintiff's combined claims for unencumbered delivery are valued at the simple property value rather than a multiple thereof, as the plaintiff's interest does not exceed the market value. Furthermore, the defendant's counterclaim for conveyance was deemed economically identical to the plaintiff's claims under the same subject matter, precluding an additional valuation. The Court clarified that it lacked authority to alter the fee determinations of the lower instances, as filing a non-acceptance complaint does not constitute the occurrence of the "main case" necessary for such modifications under the Court Costs Act (GKG).

Senat, Beschluss vom 2. Juni 2016 - V ZR 273/15, juris Rn. 4).
