The German Federal Court of Justice (II ZB 14/22) ordered that the original representative plaintiff withdrew from the model litigation appeal due to a settlement in the underlying case and formally designated a registered party as the new representative plaintiff and appellant, while simultaneously designating them as the representative respondent against the original defendant’s appeal; this procedural ruling, issued by the 2nd Civil Senate on September 22, 2023, resolved the change of party status under § 21(3) and § 21(4) of the Model Proceeding Act (KapMuG), confirming the legal basis for the court’s ex officio determination to simplify the proceedings under § 13(1) KapMuG in a collective consumer protection matter.
