The Federal Court of Justice dismissed the plaintiff's complaint for non-admission of revision, leaving the appellate court's judgment in force. The dispute involved a civil damages claim against a motor manufacturer regarding alleged violations of emission regulations, specifically challenging the lower court's denial of liability under tort and unjust enrichment provisions. The court held that the plaintiff failed to demonstrate a justifiable ground for admission because the claim under § 826 BGB was not adequately substantiated, as the defendant was a component manufacturer rather than a vehicle manufacturer, and no sufficient factual basis was provided for intentional participation in a statutory violation by the vehicle manufacturer; regarding the claim under § 823(2) BGB in conjunction with EU Regulation No 715/2007, the complaint did not establish the decisional relevance of the cited legal issues. No further reasoning was provided as it would not contribute to clarifying the conditions for admitting a revision, and the plaintiff was ordered to bear the costs of the complaint proceedings.
