Admissibility of non-admission complaint in civil revision: Rejection due to lack of fundamental legal significance and absence of need for unification of jurisprudence
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's application to suspend proceedings and rejected his non-admission complaint against the Munich Higher Regional Court's decision, thereby upholding the lower court's ruling in favor of the defendant. The dispute involved a civil law matter where the plaintiff challenged the admissibility of the appeal to the BGH, asserting that the case possessed fundamental legal significance or required the unification of jurisprudence. The court denied the complaint on the grounds that the legal issues did not meet the threshold for fundamental importance, nor did the development of law or the need for consistent legal interpretation require a decision by the revision court, as evidenced by the lack of prospects for success in a full revision; the BGH relied on its established precedents from 2020 to justify the dismissal without a further detailed written rationale. The plaintiff was ordered to bear the costs of the appeal proceedings, with the amount in dispute capped at €45,000.
