The German Federal Court of Justice (BGH) 11th Civil Senate dismissed the plaintiff’s motion to suspend the proceedings and rejected her appeal (Revision) by unanimous order, thereby upholding the lower court’s judgment. The dispute, valued at up to €35,000, concerned a civil matter where the plaintiff challenged the judgment of the 3rd Civil Senate of the Higher Regional Court of Celle dated February 26, 2020. The court refused to grant leave to appeal, finding that the legal issues did not possess fundamental significance, did not require the development of law or the securing of uniform jurisprudence, and that the appeal lacked a reasonable prospect of success. The decision relied on §§ 543 Abs. 2 Satz 1 and 552a ZPO, with the specific reasoning referenced from a prior letter by the presiding judge under § 552a Satz 2 and § 522 Abs. 2 Satz 3 ZPO.

§ 543 Abs. 2 Satz 1 ZPO

Main ground for rejecting the appeal as it does not meet the requirements for leave to appeal regarding fundamental significance, development of law, or uniform jurisprudence.

§ 552a ZPO

Procedural rule applied to reject the appeal by unanimous order because it lacks prospects of success.

§ 552a Satz 2, § 522 Abs. 2 Satz 3 ZPO

Procedural basis for referencing a previous letter from the presiding judge in lieu of a detailed written reasoning.

September 2020 (§ 552a Satz 2, § 522 Abs. 2 Satz 3 ZPO).
