Dismissal of civil appeal for lack of fundamental legal significance and prospects of success
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 11th Civil Senate rejected the plaintiff's application to stay proceedings and dismissed his appeal by unanimous order, upholding the lower court's judgment at the plaintiff's expense. The dispute concerned a civil matter with a disputed value of up to €25,000, in which the plaintiff challenged the appellate court's decision. The court determined that the appeal lacked prospects of success and that the case did not raise issues of fundamental legal significance, nor did it require a decision to ensure the further development or uniform application of law. The operative decision was grounded in § 543 Abs. 2 Satz 1 ZPO and § 552a ZPO, with the reasoning referencing a prior letter from the Presiding Judge.

September 2020 (§ 552a Satz 2, § 522 Abs. 2 Satz 3 ZPO).
