The Federal Court of Justice (BGH) 11th Civil Senate dismissed the plaintiff's application for suspension of proceedings and rejected their non-admission complaint against the Munich Higher Regional Court's February 20, 2020 decision, leaving the lower court's ruling in force. In this civil dispute concerning a claim valued up to €25,000, the plaintiffs argued that their appeal should be admitted to challenge the lower court's procedural or substantive determination, but the BGH found that the case lacked fundamental significance and did not require legal development or uniform jurisprudence. Relying on established case law and citing § 543(2) sentence 1 and § 544(6) sentence 2 clause 2 of the Code of Civil Procedure (ZPO), the court determined that a revision would not succeed, thereby denying the appeal and ordering the plaintiffs to bear the costs of the complaint proceedings.

Juli 2020 (XI ZR 387/19, juris). Von einer weiteren Begründung wird gemäß § 544 Abs. 6 Satz 2 Halbs. 2 ZPO abgesehen.

Die Kläger tragen die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Der Gegenstandswert des Beschwerdeverfahrens beträgt bis zu 25.000 €.
