The Federal Court of Justice (BGH) dismissed the plaintiff’s application to suspend proceedings and rejected the plaintiff’s revision via a unanimous summary order, leaving the judgment of the Stuttgart Court of Appeal from November 12, 2019, in force in favor of the defendant. The dispute concerned a civil matter where the plaintiff appealed the lower court’s decision, with a determined amount in controversy of up to €30,000. The BGH based its decision on the procedural grounds that the case lacked fundamental legal significance, did not require the development of law or the securing of uniform jurisprudence, and the revision had no prospect of success, pursuant to §§ 543(2) sentence 1 and 552a of the Code of Civil Procedure (ZPO).

September 2020 (§ 552a Satz 2, § 522 Abs. 2 Satz 3 ZPO).
