Insolvency suspension of non-admission complaint proceedings and denial of legal aid for unprosperous litigation
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision regarding the substantive liability claims, thereby upholding the appellate court's ruling, but left the proceedings regarding the auxiliary duty to provide information suspended indefinitely due to the defendant's insolvency. The dispute arose from a civil litigation where the defendant, having been placed under bankruptcy administration, contested the lower courts' judgments. While the court found no questions of fundamental significance or need for legal unification to justify revising the liability determination under § 543 Abs. 2 ZPO, it held that the insolvency initiation permanently suspended the procedural status of the non-admission complaint for the information claims because the insolvency administrator could not validly release or resume these specific proceedings. Consequently, the operative outcome is a partial dismissal of the appeal with the remainder of the proceedings in abeyance.

Wirkung der Insolvenzeröffnung: Bleibende Unterbrechung des Verfahrens der Nichtzulassungsbeschwerde nach Unterbrechung des Passivprozesses
[TENOR]
BGH, Urteil vom 18. März 2010 - I ZR 158/07, BGHZ 185, 11 Rn. 31 mwN) bislang nicht erfolgt ist.
Die Kostenentscheidung bleibt der Schlussentscheidung vorbehalten.
