Legislator-Zusammenfassung

The Bundesgerichtshof (XI ZR 188/22) dismissed the plaintiff’s complaint against the non-admission of revision, thereby upholding the Munich Higher Regional Court’s judgment and leaving the lower court's decision in force; the plaintiff, who bears the costs of the appeal, did not prevail. The dispute concerned liability for distribution and management authority in a commercial context, where the plaintiff challenged the finding that the defendant entity was not responsible for sales or operational control. The court held that the case lacked fundamental legal significance and that the appeal offered no prospects of success, citing the specific contractual assignment of distribution duties to a third-party limited liability company and the absence of any management authority on the part of the defendant, thus rendering a revision hearing unnecessary under Section 543 of the Code of Civil Procedure.

2 ZPO abgesehen.

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1, § 565 Satz 1, § 516 Abs. 3 ZPO).

Der Gegenstandswert für das Beschwerdeverfahren beträgt bis 35.000 €.
