Rebooking of court cost payments to unpaid fine: Inadmissibility of appeal without grant of leave under § 29 EGGVG
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Division dismissed the complainant’s appeal as inadmissible at his own cost, leaving the lower court’s decision rejecting the request to re-book payments to a fine in force. The dispute concerned a case within the jurisdiction of the judicial administration, where the complainant challenged the Higher Regional Court’s refusal to re-allocate funds previously credited toward court costs to satisfy an outstanding monetary penalty. Relying on § 29 Abs. 1 EGGVG, the court held that an appeal to the Federal Court is only permissible if the Higher Regional Court has explicitly granted leave; as the lower court remained silent on this requirement, the leave was deemed not granted, rendering the appeal legally insufficient regardless of its substantive merits.
