Non-admission complaint in housing eviction: Subject matter value calculated via rent index instead of contractual term
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the tenant's application for legal aid to file a non-admission complaint against the Landgericht Bückeburg's decision, thereby upholding the lower court's ruling. The dispute concerned the eviction of residential premises, specifically the calculation of the subject matter value required for the admissibility of an appeal. The court held that the non-admission complaint was inadmissible because the value of the grievance (Wert der Beschwer) was only €18,480 (calculated as 42 times the monthly net rent of €440), falling below the statutory threshold of €20,000 mandated by § 544 para. 2 no. 1 ZPO, and thus could not be increased by the existence of a contractual prohibition of termination. Furthermore, the court found no prospect of success regarding the alleged grounds for admission under § 543 para. 1 ZPO, as the legal question regarding when criminal police reports justify a summary eviction lacks general significance and is dependent on specific individual circumstances.
